The following Terms and Conditions are entered into between you and Junk Cars World and represent a legal agreement between you and Junk Cars World. By accessing the website junkcarsworld.com you are agreeing to abide by the following Terms, which govern all use of this Website and the services available through Website. Please take time to read this agreement before accessing or using the Website. These Terms govern your access use the Website and Services. If you do not agree with any of these Terms or do not wish to be bound by these Terms, your only option is to not use or access this Website.
We reserve the right, at our sole discretion, to modify or replace any part of these Terms. It is your responsibility to check these Terms periodically for changes. Your continued use of or access to the Website following the posting of any changes to these Terms constitutes acceptance of those changes.
Age and Jurisdiction
This Website is offered and available to users who are eighteen (18) years of age or older and reside in the United States. By using this Website, you represent and warrant that you are of legal age to form a binding contract with Junk Cars World and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.
The Website is not intended for users under the age of thirteen, and we do not knowingly collect personally identifiable information from users under the age of thirteen. Such users are expressly prohibited from registering for the Service or submitting their personally identifiable information to us, and from using portions of the Website for which registration is required.
Prohibited Items
A buyer cannot pick up any hazardous or dangerous materials along with or inside of any vehicle. Hazardous or dangerous items are those that may pose a danger to the health, safety, or property of any person during transport (such as explosives, radioactive materials, flammable gases and solids, and toxic substances). Items that Junk Cars World cannot service include parts, scrap metal, and liquids
Dispute Resolution: Should you have a dispute with one ofJunk Cars World Buyers, In no event will We or our Suppliers or Licensors be liable with respect to any subject matter of this Agreement under any Contract, Negligence, Strict Liability, or other legal or equitable theory for: (1) Any special, incidental, or consequential damages; (2) the cost of procurement of substitute products or services; (3) for interruption of use or loss of corruption of data; or (4) for any amounts that exceed the fees paid by you to us (if any) under this Agreement during the twelve (12) month period prior to the cause of action. We shall have no liability for any failure or delay due to matters beyond our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Dispute between you and Junk Cars Worlds regarding our services should be reported to the Junk Cars World Customer Services Department. We will attempt to resolve any disputes you have with us.
Except to the extent of applicable law, if any, provides otherwise, this Agreement and any access to or use of the Website will be governed by the laws of the state of new jersey. Junk Cars Worlds uses proprietary screening methods for buyers and sellers. However, no method is perfect. we are not responsible for resolving any disputes between you and Buyers or Carriers regarding services. If you report a dispute to Junk Cars World, we will make every effort to help both parties communicate effectively; however, all disputes must be resolved directly between you and the opposing user.
Warranties/Representations made by seller: As a seller, you must legally be able to sell the car on which make a request and then accept an offer. You understand and agree that it is your sole obligation to comply with all local, state and federal laws, rules, statutes, and regulations that may apply including, any local, state and federal licensing, insurance, or titling requirements.
You are also solely responsible for the accuracy of any information you provide to Us and our Buyers and any others in the Offer, transportation, or payment process. You represent and warrant that the information you provide is true, legal, accurate, and not fraudulent. You may not accept an offer on any vehicle that could cause Us and our Buyers to violate any applicable law, statute, ordinance, or regulation. You authorize Junk Cars World to use any information you supply through our site or any other medium in connection with our services and in accordance with these terms. Should any of the information you have submitted raise suspicion that you were fraudulent, or be deemed fraudulent, Junk Cars World may suspend your claim or Offer.
Offer: An “Offer” is the amount of money and/or service (i.e. towing service) put forward by the dispatcher. The Offer constitutes the beginning of a transaction between the Buyer and a Seller. Offers are contingent upon the accuracy of a vehicle’s information submitted by the Seller. Buyers may reserve the right to change or terminate their Offers upon inspection of the vehicle. Offers are subject to change or termination at any time.
Seller: “Sellers” are participants of Junk Cars World service who submit information about their vehicle in hopes of receiving an Offer to purchase their vehicle. When a Seller receives and then accepts an Offer from a Buyer, their contact information will be passed on to the Buyer. The Seller is then contacted by the Buyer to arrange for the vehicle to be picked up. The Buyer will also make arrangements with the Seller to make payment. By acting as a Seller, you acknowledge that you are at least 18 years of age and have submitted only accurate and truthful information. Minors may use the services Junk Cars World provides only in conjunction with the consent and supervision of their parents or guardians.
Buyer: “Buyers” are partners of Junk Cars World who place Offers on vehicles submitted by Sellers. The Offer amount is based upon the vehicle’s information that the seller submits. Shall the vehicle information be deemed inaccurate or fraudulent the Buyer retains the right to change or cancel their Offer. Each Buyer has their own process for determining what a vehicle is worth. When an Offer is accepted by a Seller, the Seller’s contact and other pertinent information is provided to the Buyer in order to begin the transaction.
Payment: Each of the Buyer’s with have their own policy for payment. It is your duty to verify how payment will be made prior to the scheduled pickup time.
Prior to payment, regardless of the method, the Buyer and or Carrier is entitled to inspect the vehicle. Inspection may occur at the time of pickup or when the vehicle arrives at the location of the Buyer. If any of the information provided to Junk Cars World is found to be inaccurate at the time of inspection, the Buyer reserves the right to terminate or recalculate the original offer. Shall no new agreement be made the vehicle may be returned or not picked up. If a Seller does not accept the return of a vehicle, it may be deemed abandoned, which will result in nonpayment and may open up the Seller to other liabilities, including and not limited to statutory infractions service fees or storage fees.
